The Nigerian Army Special Court Martial has pronounced Judgement on the case of Nigeria Army vs Major General Umar Mohammed with a 7 years prison sentence among saveral amount of money he was orderd to pay back.
Major General UM Mohammed was found guilty in 14 charges out of the 18 count charges levelled against him by the court Marshall that sat at the Command Officer's Mess, Asokoro, Abuja on Tuesday, 10th October, 2023.
The pronouncement of the court Marshall lead by the President of the Court Martial, Major General James Myam, proceeded its findings on 4th of October 2023 on the case.
Major General Myam while making the sentencing gave the judgements as follows: On Count 1 charged with stealing, the accused was found guilty and sentenced to 5 years imprisonment and ordered the General to pay back the sum of one million and forty five thousand, f9ur hundred United States Dollars to Nigerian Army Properties Limited.
Similarly on Count 2, 3, 4, 5, and 6, the Senior Officer charged with stealing on these counts was found and sentence to 5 years imprisonment with orders to pay various sums of money stolen. On Count 7, the court found General Um Mohamed not guilt and was discharged and acquitted
"Count 8 charged with forgery, the court found the officer guilty as charged and sentence to 7 years imprisonment. On Count 9, General UM Mohammed was charged with theft and found guilty. The court pronounced a 5 years imprisonment sentence and ordered him to pay back the sum four hundred and thirty thousand, eight hundred us dollars ($430,800) to Nigeria Army Properties Limited of dollars to Nigerian Army Properties Limited"

"Count 12, Conduct to prejudice of service discipline, findings guilty and Sentence two years imprisonment. Count 13 theft, findings guilty, sentenced to 5 years imprison and ordered to pay back 74 million to Nigerian Army Properties Limited. Count 14, criminal misappropriation, finding guilty and sentenced to 2 years imprisonment and further ordered the offiver to pay back the sum of 590 million naira to FCC NAPIL Properties Limited"
"Count 15, Criminal misappropriation, found guilty and sentenced 2 years imprisonment and further orders the payment of 255 milion naira. Count 16, criminal misappropriation, findings guilty and sentence two years in prison. Ordered to oay back the sum of five hundred and fifty nine million, one hujdred and seventy two thousand naira. Count 17 criminal misappropriation and found not guilty, was therefore discharged and acquited. Count 18,criminal misappropriation, found guilty and Sentence to two years in prison. He was also ordered to pay back the sum of 172 million".
According Major General James Myam, "all the Sentences are to run concurrently which are subject to confirmation of the military Council".
Meanwhile, a Senior Advocate of Nigeria and Council to Major General Umar Mohammed, Olalekan Ojo says if his client wishes to appeal the judgement passed by the Nigerian Army Special Court Martial, it is within his right to do so.
This follows the Seven years prison sentence among sentences passed by the Army Court Marshal on the former Chairman and Group Managing Director Nigerian Army Properties Limited whose trial began in 2022 over 18 counts allegations.
Olalekan Ojo SAN, says the Decision by the Army Council will determine the next steps for his client.
